now what?
SIX PHASES OF THE TYPICAL TRADEMARK APPLICATION:
Patience
Once you approve the draft application, it will be timely submitted by our firm. At this point it is out of our hands for a moment - about 3-4 months, at which time we will receive notification that it has been assigned to an Examiner for review
Publication
Applications not receiving office actions move right to publication, but others must have office actions resolved before publication can occur. Publication 30 days for others to file oppositions to your trademark application
Communication
We will always keep you in the loop any time we receive communication from the Examiner. Often times simple problems with an application can be resolved with a phone call between our firm and the Examining Attorney
Notice of Allowance
After a successful publication, or after the resolution of an opposition, the Examiner your application with a Notice of Allowance. If your application was submitted prior to commerce, we must now provide evidence
Office Action
Every application has some level of risk for an office action. Once your examination is complete our firm will receive notice of any office action. Non-substantive actions will be handled as part of your application process and fee
Registration
Once a Notice of Allowance is granted, applications with goods or services in commerce will receive a registration certificate in 2-3 months. Applications not in commerce will also receive a registration certificate in 8-9 months
