By using this website (the “Website” or “Site”), you are agreeing to comply with all terms and conditions herein and be bound to the terms of use. By using this website you further agree that you are at least 18 years of age, and able to enter into a contract. Please review all terms carefully. If you do not agree with any of the terms and conditions here, you should not use this Site. The terms “Attorney” “Monica Ugliuzza Law, Inc.” “Monica L. Ugliuzza” “Creative Law Studio” “us” “we” and ”our” refer to Monica L. Ugliuzza Law, Inc. the owner of this Site. The term “you” and “potential client” refers to the viewer of this Site.

The Firm – Who is Monica? What is a Ugliuzza? And what is the Creative Law Studio?

Creative Law Studio is the federal trademark and copyright practice of Monica Ugliuzza Law, Inc. (the “Firm.”) As owner of the Site, Monica Ugliuzza Law, Inc. reserves all rights to the information provided on this Site. Monica L. Ugliuzza (the “Attorney”) is licensed to practice in the Commonwealth of Pennsylvania, and licensed federally for trademark and copyright matters under the United States Patent and Trademark Office. The Attorney maintains an office within the Law Firm of Halbruner, Hatch & Guise, LLP, (“HHG”) as an of counsel attorney (independently contracted attorney).

Acceptance of Agreement – Just a baby step 

By your use of the Site, you are forming an agreement to the terms and conditions herein. This agreement constitutes the entire and only agreement between you, as a potential client, and us and shall supersede any prior or contemporaneous agreements or representations. Upon the engagement of an attorney-client relationship, the engagement letter shall supersede, but this agreement shall remain valid for Site use.

No Legal Advice – A little information and pretty pictures

The contents found on the Site are for advertising, educational and entertainment purposes only. These materials do not and are not intended to constitute legal advice, recommendations, mediation or counseling under any circumstances, but rather to inform the reader of legal services available. Until such time that an attorney-client relationship is created, no legal advice will be provided. We do not warrant or guarantee the accurateness, completeness or adequacy of the information contained in or linked to the Site.

Attorney-Client Relationship – This relationship is not “official” until we’re “engaged”

We welcome inquiries, phone calls and emails from prospective clients. No attorney –client relationship will be created until the proper signing of an engagement letter and specified payment. The hiring of a lawyer is an important decision and we welcome your questions. Non-clients contacting us by email should refrain from disclosing information which they would consider sensitive or confidential until and unless an attorney-client relationship has been established. Upon the commencement of an attorney-client relationship, the engagement letter will set forth the understandings between attorney and client and will specify and restrict Attorney’s representation to those matters and projects contemplated. 

 

Payment for Legal Services

The engagement letter will also provide client with a price for the legal services being purchased. There may be situations where it is not possible to provide an accurate price prior to the commencement of legal services. In such cases, you will be required to pay a specified retainer, which we will bill against at the then-current hourly rate. You represent and warrant that upon your payment to us that (i) any credit information you provide is factual and complete, (ii) charges incurred will be honored by your credit card or debit card and (iii) you will pay all fees within the timing required by us. By acceptance of a fee agreement, all payments will be made on this Site, through LawPay and are placed in the account of HHG.

Paperless Firm – Yes, we hug trees

Upon engagement with the Firm, you are agreeing to receive all communication electronically. Creative law studio strives to maintain a paperless environment and as such, electronic signatures and payments are required. We are also a web-based boutique firm, which means you are agreeing to our filing and document services such as Dropbox, AltLegal, Calendly, LawPay and HelloSign (all services subject to change without notice). Please know that all steps have been taken to ensure your privacy and security of electronic communication. We have carefully chosen the above-mentioned filing and document services based on proven security and privacy standards.

Copyright – Like you, we are creative too

Like you, we are creative. And also like you, we are just trying to display our creative content and maintain our ownership. We will always respect your intellectual property and help you to protect it. All content on this Site is officially copyrighted and owned by Monica Ugliuzza Law, Inc., and we ask that you refrain from unauthorized copying.

License - We’ll grant you a license – but its limited

You are granted a fully revocable license to view, access, link and “share” this Site. The following limitations shall apply (i) your use of this Site is personal and for non-commercial purposes (ii) you may print pages of this site, but only for personal, non-commercial use (ii) any printing of this Site shall include the copyright policies on the then-current Site version, likely at the bottom of the page.

Linking - So you want to like, link and share us with your friends

You are welcome to share the link to this site on your social media provided that (i) you are not engaged in illegal or unethical activities (ii) you refrain from making any changes or removing information as provided on this Site and (iii) you immediately remove any “shares” or links to the Site upon our request, which may be made for any reason.

Third Party Terms – We all have friends

From time to time, we may recommend third parties, or share information from third parties that are applicable to small businesses, start-ups, entrepreneurs and those interested in intellectual property protection. No third party mentioned on this Site or any related advertisement shall be considered legal advice. If you choose to visit any third party mentioned on this Site, We are not responsible for information provided by such third party. We are an independent contractor, as the merchants, and we shall not become responsible for one another. If you should choose to become a client/customer of a third party, We are not a party to any of your future transactions with such third party. Any agreements you enter into, or any purchases you make from third party are at your own discretion and you assume all related risks. By mentioning, writing content with, or advertising for a third party, we do not by express or implied means, warrant the fitness of the third party. We provide no warranties of title, fitness for particular purpose, or merchantability of the third party or third party’s products and services.

Privacy Policy – Don’t share too much, too soon

We ask that you do not provide information that is sensitive or confidential until such time that an engagement has been signed. Though We are bound to confidentiality, we ask that you allow Us to run a conflict check prior to receiving your confidential information, intellectual property or other sensitive information. The conflict check will tell Us if We have any personal or professional conflicts that would prohibit Us from working as your Attorney. Upon a future engagement, all information you provide is confidential and We will be bound by the laws of confidentiality and the laws of attorney-client privilege.  We reserve the right to make changes to this privacy policy in the future.

Transferability – You can’t just pass us along 

You have been granted a limited license to use and view this Site. This license is not transferable to any other party. If you are granted a user profile or password, this information or documents received by us are not transferable.

Legal Compliance and Agreement

If any dispute arises out of, or in relation to a claimed breach of this Agreement, or any other disagreement of any nature, type or description, regardless of the facts of the legal theories, which may be involved, such dispute shall be resolved by binding arbitration by a single arbitrator before the State Bar of Pennsylvania.
